Minetory Gratification – Dealer/Distributor Loyalty Program

These terms and conditions (“Terms”) govern participation in the loyalty programme (“Program”) managed and operated by Mobilnxt India Pvt Ltd (“Mobilnxt” ) on behalf of various brands for its dealer/distributor network. By participating, you (“Participant”) agree to abide by these Terms.

 

•The Program is open only to authorized dealers and distributors of the Client as communicated by the Client.

•Participants must be legally eligible and compliant with applicable laws and licensing to do business in India.

•Employees of Mobilnxt, the Client, and their affiliates are not eligible to participate.

 

•The Program duration, including the start and end dates, shall be communicated separately via official communication channels (email, portal, app, etc.).

•Mobilnxt and the Client reserve the right to alter the Program duration at any time with prior notice.

 

•Participants will earn reward points based on the sales/purchase data submitted or validated by the Client or through other specified criteria.

•Points will be credited as per the predefined matrix, which may vary by product, region, or time period.

•Mobilnxt is not responsible for errors in data submission by the Participant or inaccuracies in data shared by the Client.

 

•Points earned can be redeemed for rewards listed in the reward catalog, subject to availability.

•Mobilnxt will process redemptions on behalf of the Client and arrange for delivery of the rewards.

•All rewards are subject to availability, substitution, or discontinuation without notice.

•Delivery timelines and warranty of products are as per third-party supplier terms.

 

•Any tax liability, including TDS, GST, or other statutory levies arising out of rewards or incentives, shall be borne by the Participant.

•Mobilnxt may issue TDS certificates, if applicable, and reserves the right to deduct tax as per applicable law.

 

•Any fraudulent activity, including manipulation of sales data or misrepresentation, may lead to immediate disqualification and forfeiture of rewards.

•Mobilnxt and the Client reserve the right to audit entries and request documentation to verify eligibility and claims.

 

•Participant data may be used for the purpose of executing the Program, including communication and reward fulfilment.

•Mobilnxt will maintain reasonable safeguards to protect personal and business information but is not liable for breaches beyond its control.

 

•Mobilnxt acts only as a facilitator of the Program and shall not be held liable for any direct, indirect, incidental, or consequential damages arising from participation.

•All obligations relating to the quality of rewards rest with the supplier or manufacturer.

 

•The Organizer and the Client reserve the right to amend, suspend, or terminate the Program at any time without prior notice.

•Continued participation following any changes constitutes acceptance of the modified Terms.

 

•These Terms shall be governed by and construed in accordance with the laws of India.

•Disputes arising in connection with the Program shall be subject to the exclusive jurisdiction of the courts in Delhi.
